KChange LLC (“Company”,“us”, “we”, or “our”) operates The Website https://kchange.com and THE MOBILE APPLICATION “KChange” available on Google Play Store (hereinafter together or individually referred to as “Services”).
Our Privacy Policy governs your visit to https://kchange.com and our Mobile Application “KChange”, and explains how we collect, safeguard and disclose information that results from your use of our Services.
We use your data to provide and improve Services. By using Services, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.
Our Terms and Conditions (“Terms”) govern all use of our Services and together with the Privacy Policy constitutes your agreement with us (“agreement”).

b) EFFECTIVE DATE: "Effective Date" means the date this Privacy Policy comes into force and effect.
c) PARTIES: The parties to this privacy policy are the following data controller: KChange LLC ("Data Controller") and you, as the user of this Services. Hereinafter, the parties will individually be referred to as "Party" and collectively as "Parties."
d) DATA CONTROLLER: Data Controller is the publisher, owner, and operator of the Services and is the Party responsible for the collection of information described herein. Data Controller shall be referred to either by Data Controller's name or "Data Controller," as listed above. If Data Controller or Data Controller's property shall be referred to through first-person pronouns, it shall be through the use of the following: us, we, our, ours, etc.
e) YOU: Should you agree to this Privacy Policy and continue your use of the Services, you will be referred to herein as either you, the user, or if any second-person pronouns are required and applicable, such pronouns as 'your", "yours", etc.

By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries, where you may not have the same rights and protections as you do under local law.
Article 5 - MODIFICATIONS AND REVISIONS:
We reserve the right to modify, revise, or otherwise amend this Privacy Policy at any time and in any manner. If we do so, We will notify you of any changes by posting the new Privacy Policy on this page.
We will let you know via email, in app notifications, SMS, alerts within our Services and/or a prominent notice on our Services, prior to the change becoming effective and update “effective date” at the top of this Privacy Policy.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
Article 6 - THE PERSONAL DATA WE RECEIVE FROM YOU:
Depending on how you use our Services, you will be subject to different types of Personal Data collected and different manners of collection:
a) Registered users: You, as a user of the Services, may be asked to register in order to use the Services and purchase any features available for fee / sale / subscription.

0.1. Users can post details of the products ( Title, Category / Sub Category of the product type, Product search tags, Condition of the product, Description of the product, User location Zip code) they own or have all the legal authority on the said product.

Users can post details of the services ( Title, Category / Sub Category of the services, Company name, website / Facebook and other social media links of the user or their company, Service search tags, Description of the service provided or company or user, User / company location Zip code) they can provide to other Users as permitted by Law.
0.3. Users can upload photos of the products they own or have all the legal authority on the said product.
0.4. Users can upload photos of the services they can provide to other users as permitted by Law.
0.5. Users can chat with other users.
0.6. Users can write reviews about other user listings.
0.7. Users can give ratings for other users.
0.8. Users can enroll in a monthly paid subscription and make payment using our third party payment processors.
0.9. Users can pay for paid features like “bidding” for a fee collected by our third party payment processor.
By undergoing the registration process, you consent to us collecting your Personal Data, including the Personal Data described in this clause, as well as storing, using or disclosing your Personal Data in accordance with this Privacy Policy.
b) Unregistered users: If you are a passive user of the Services (just visiting our website or downloading and installing our Services) and do not register, you may still be subject to certain passive data collection ("Passive Data Collection"). Such Passive Data Collection may include through cookies, as described below, IP address information, device information (hardware & software), location information, and certain browser data, such as history and/or session information.
c) All users: The Passive Data Collection that applies to Unregistered users shall also apply to all other users and/or visitors of our Services.
d) Sales & Billing Information: In order to purchase any of the features on the Services, you will be asked to provide certain payment information (credit card, debit card), billing address information, and possibly additional specific information so that you may be properly charged for your purchases. This payment and billing information will be handled by our third party payment processor and will not be stored in our Services and will be used exclusively to assist with your one-time purchase.
e) Related Entities: We may share your Personal Data, including Personal Data that identifies you personally, with any of our parent companies, subsidiary companies, affiliates or other trusted related entities.
However, we only share your Personal Data with a trusted related entity if that entity agrees to our privacy standards as set out in this Privacy Policy and to treat your Personal Data in the same manner that we do.

g) User Experience: From time to time we may request information from you to assist us in improving our Services, and the features we offer, such as demographic information or your particular preferences.
h) Content Interaction: Our Services may allow you to comment on the content that we provide or the content that other users provide, such as social media, blogs, multimedia, or forum posts. If so, we may collect some Personal Data from you at that time, such as, but not limited to, username or email address.
i) Combined or Aggregated Information: We may combine or aggregate some of your Personal Data in order to better serve you and to better enhance and update our Services for your and other consumers' use.
j) Other Information: In addition to collecting the Personal Data as already described herein, we may also collect the following Personal Data:
Subjects / professional crafts user can teach, Subjects / professional crafts user need tutoring, Languages known by user, Language preference of user, Country information from where the user has registered in the app, Gender preference of the user, Current educational level (school grade, College Level, skill level) of the user, Educational qualifications of the user, Skill Level (Basic, Intermediate, professional) of the user.
Article 7 - THE PERSONAL DATA WE RECEIVE AUTOMATICALLY:
Cookies: We may collect information from you through automatic tracking systems (such as information about your browsing preferences) as well as through information that you volunteer to us (such as information that you provide during a registration process or at other times while using the Services, as described above).

The aforementioned information is processed in an automated form and collected in an exclusively aggregated manner in order to verify the correct functioning of the site, and for security reasons. This information will be processed according to the legitimate interests of the Data Controller.

Personal Data is stored throughout your relationship with us. We delete your Personal Data upon request for cancelation of your account or other general request for the deletion of data. Please refer to “Article 13 - ACCOUNT INFORMATION.” of this policy.
In the event of a breach of your Personal Data, you will be notified in a reasonable time frame, but in no event later than two weeks, and we will follow all applicable laws regarding such breach.

BUSINESS USE: SHARING WITH THIRD PARTY PARTNERS AND CUSTOMERS:
Information that does not identify you personally, but that may assist in providing us broad overviews of our customer base, may be used for market research, marketing efforts of us, our third party partners and customers. Such information may include, but is not limited to, interests based on your cookies and other information we may receive from other third party companies and sources.
We will de-identify your information by removing your name, email address and any other information that will personally identify an individual. We will combine and aggregate the data from various users and develop data models or data sets. For example, we will develop a data model for Video Games. This data model will have information on type / genre of video games, gaming consoles, location information like zipcode, assumed age range, assumed gender, and this data model will be shared with third party partners and companies.

Although our policy is to maintain the privacy of your Personal Data as described herein, we may disclose your Personal Data if we believe that it is reasonable to do so in certain cases, in our sole and exclusive discretion. Such cases may include, but are not limited to:

Our Services are not intended for use by children under the age of 18 (“Child” or “Children”).

You may update, correct or remove certain account profile information at any time by logging in to your account on our Services. If you would like to cancel your account entirely, please contact us, and enter your request for cancellation, and the same will be honored on successful verification of the request and the sender. Please note that we may retain certain information as required by law or for legitimate business purposes. For example, any reviews, postings and similar materials posted by you may continue to be publicly available on our Services in association with your account name even after your account is cancelled. We may also retain cached or archived copies of information about you for a certain period of time.

We may allow users to post their own content or information publicly on our Services. Such content or information may include, but is not limited to, your name, your product details (photos, category/sub category, description, location availability like Zip code), your service details (photos, category/sub category, description, location availability like Zip code), your social media links, your company name, your company website, your website, your profile picture, photographs, status updates, blogs, articles, your reviews, your ratings, your chat communication with other users, or other personal snippets. Please be aware that any such information or content that you may post should be considered entirely public and that we do not purport to maintain the privacy of such public information.

We may use third-party Service Providers to show advertisements to you to help support and maintain our Service.
Article 16 - BEHAVIORAL REMARKETING:
We may use remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Service.

We may provide paid products and/or features within our Services. In that case, we use third-party services for payment processing (e.g. payment processors).
We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. As such, you agree that any email sent from us or third-party affiliates, even unsolicited email, shall specifically not be considered SPAM, as that term is legally defined.

If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.
0.3. To stop selling your personal information. We don’t sell or rent your personal information to any third parties for any purpose. We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of personal information to a third party, or within our family of companies, without monetary consideration may be considered a “sale” under California law. If you submit a request to stop selling your personal information, we will stop making such transfers.
Please note, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

To submit a request to know or a request to delete, In both cases, we will verify your request by asking you to provide information that matches information we have on file about you. You may designate another person as your authorized agent to act on your behalf with regard to CCPA requests. If you have designated an authorized agent to submit requests on your behalf, we will require proof that the person is authorized to act on your behalf and may also still ask you to verify your identity with us directly.
